What is a Private Attorney?

Attorneys are professionals who are licensed to practice law in one or multiple states. They may also be called lawyers or attorneys at law.

In general, practicing law means representing clients in court or providing legal advice as well as other services. Lawyers perform many tasks and provide many different services to their clients during their everyday work.

There are some attorneys who practice in many different areas of law while others specialize in one area or just a few areas. Lawyers may practice alone in a solo practice, with a partner, or in a group such as a law firm.

In order to become a lawyer, an individual is required to graduate law school and pass the state bar examination in the state where they will be practicing. Each state has its own state bar association.

Lawyers are required to be licensed in each state in which they intend to practice, although there are some states which have cross-licensing programs. In the United States, lawyers are also required to pass certain background checks as well as professional responsibility tests before they are permitted to practice law.

In their practice, an attorney may perform various tasks, including:

  • Representing clients in a court of law;
  • Counseling clients on their legal inquiries and concerns;
  • Examining laws and pleading in court;
  • Analyzing the evidence for trial;
  • Engaging in discovery, or obtaining documents to prepare for trial;
  • Requesting appeals, if possible;
  • Requesting damages for injuries; and Engaging in criminal defense or prosecution.

There are over a million licensed attorneys in the United States who work in private practice. This means that they have a solo practice or they work in a law firm with two or more attorneys.

Lawyers who work in private practice, or “private lawyers,” may also employ other legal professionals to assist them, including:

  • Legal secretaries;
  • Paralegals;
  • Law clerks;
  • IT personnel;
  • Litigation support professionals;
  • Law firm administrators;
  • Marketing personnel;
  • File clerks; and
  • Legal medical consultants.

What is the Difference between a Private Attorney and a Court-Appointed Attorney?

There are differences between a private attorney and a court-appointed attorney, although some private practice attorneys may also take on court-appointed cases. Court-appointed lawyers provide legal services to defendants in criminal cases because defendants in these types of cases have the right to an attorney.

This means that if a defendant cannot afford their own attorney, the court will provide them with one. These attorneys are referred to as court-appointed attorneys or public defense attorneys.

These attorneys are appointed by the state to represent criminal defendants during their criminal proceedings. A court-appointed attorney will perform similar tasks to a private practice attorney, including:

  • Representing the defendant in court;
  • Analyzing the facts of the case; and
  • Providing the defendant with legal advice.

It is important to note that, even though a court-appointed attorney is a constitutional right, an individual has to qualify for one as well as request one from the court. The defendant’s first opportunity to request a court-appointed attorney is typically at their arraignment.

The arraignment is when the charges are brought against the defendant. The request may also be made during the bail hearing.

If an individual does not qualify for a court-appointed attorney, they can hire a private attorney to defend them in court.

How Do I Find a Private Attorney Near Me?

When an individual has a legal issue, their first concern is often how to find a lawyer. Unless they already have recommendations from close friends or family members, finding an attorney can be an overwhelming and stressful experience.

A common way that many individuals find attorneys now is by searching for “private lawyers near me.” This method, however, is time consuming and often provides inaccurate results the individual must then sort through.

For example, the individual may receive generic results that direct them to another website or database or they will receive a list of ads for companies providing attorney referral services. Although these may be somewhat helpful, an individual will most likely not find the right attorney if they do not know the proper search parameters to enter in order to find the type of lawyer who handles their case.

For example, if an individual is facing criminal charges, they will need a criminal defense lawyer to represent them. There are many different types of lawyers and it becomes much more difficult to find the right one when an individual is unsure of what legal category their issue falls into.

In addition, the type of lawyer is only one of several filters an individual will need to know prior to beginning their search. For example, an individual may locate an attorney who practices in the correct area of law but who focuses on the transactional side of cases and does not represent clients in court.

An individual will also have to find an attorney who is admitted to practice law in their jurisdiction. In addition to asking personal connections or trusting word of mouth recommendations, other common ways that individuals search for lawyers include:

  • Reading news articles that mention firm names;
  • Looking through the Yellow Pages or another phone book;
  • Finding the number of a lawyer or law firm or lawyer on:
    • public transportation advertisements;
    • television commercials; or
    • billboards;
  • Conducting an online search;
  • Visiting or contacting the website of the local state bar association;
  • Using an attorney referral service; and
  • Contacting a legal aid service or a non-profit organization that will provide legal contact information free of charge.

In this digital age, there are also new ways to hire lawyers online, as some lawyers have accounts on social media platforms. Many lawyers are also using video technology to conduct consultations and meetings with their clients, including using services such as Zoom.

One method an individual can use to search for an attorney online is LegalMatch. LegalMatch has simplified the process for potential clients by allowing them to present their case for free in as little as 15 minutes.

Within about 24 hours, an individual will receive responses from attorneys in their area who are ready to begin work on their case. The individual can then review the lawyer’s fees, background, and reviews and determine which one is the best fit for their needs.

In many cases, attorneys will offer an initial consultation free of charge. Consultations essentially provide a potential client with the opportunity to interview an attorney before formally hiring them to ensure they will be a good fit.
