Kyle is a city in Hays County, Texas. The 2000 census reported that it had a population of just over 5,300. However, the 2008 estimate by the Census Bureau places its population at around 26,000, making it one of the fastest-growing cities in the United States. Kyle was founded in 1861, and the site for the town, like many during that era, was chosen because of its proximity to a major cross-country railroad. In the 1940s, Kyle was the only town in the United States to have an all-woman government.
The city of Kyle was recently involved in a lawsuit brought against it by the NAACP and the National Association of Homebuilders, alleging that the city was involved in housing discrimination. The lawsuit alleged that an ordinance passed by the city of Kyle which imposed certain minimum size requirements, and requirements for all-masonry construction, on new homes built in the city. The plaintiffs alleged that this drove up the average cost of new homes in Kyle by nearly $40,000, and that this may have been motivated by a desire to make it more difficult for minorities to move into the city.
The trial court ruled against the NAACP and NAHB, saying that while towns cannot use their zoning power in a discriminatory manner, the fact that a zoning ordinance raises the price of new homes is not, by itself, enough to prove that discrimination has occurred. The case is currently on appeal in the U.S. Fifth Circuit Court of Appeals.
